By using Link Communications, Ltd. Internet Services (LNKCOM) the user agrees to abide by these Terms & Conditions at all times. All users will be notified by e-mail when these Terms Of Use are updated.

a) LNKCOM exercises no control whatsoever over the content of the information passing through the Dial-Up Personal Account, Business Dial-Up Account, and/or Web Hosting Account billed to The Client. LNKCOM makes no warranties of any kind, whether expressed or implied, for the service it is providing. LNKCOM also disclaims any warranty of merchantability or fitness for a particular purpose. LNKCOM will not be responsible for any damage suffered by The Client. This includes, but is not limited to, loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions caused by its own negligence or The Client's errors or omissions. Use of any information obtained via LNKCOM is at The Client's own risk. LNKCOM specifically denies any responsibility for the accuracy or quality of information obtained through its services.

b) The rights of access conveyed by these Terms Of Use are non-transferable. Use of a LNKCOM account is expressly limited to the individual whose name appears on the attached Agreement; for business accounts, the name of the company whose name appears.

c) The use of LNKCOM for advertising or promotion of a commercial product or service without the express, written consent of LNKCOM is prohibited. Violators are subject to immediate termination of their account. LNKCOM also maintains a ZERO TOLERANCE SPAM POLICY.

d) If the Client is less than eighteen (18) years of age, this agreement must be signed by his/her parent or legal guardian who assumes responsibility for all charges related to use of The Client's account.

e) The Client is responsible for all use of The Client's account(s) and confidentiality of password(s). LNKCOM will suspend access or change access to The Client's account(s) within twenty four (24) hours or less after notification by The Client that his/her password has been lost, stolen or otherwise compromised.

f) The Client is responsible for any and all local or long-distance telephone charges for connecting to LNKCOM.

g) SERVICE FROM LNKCOM IS PROVIDED ON AN 'AS IS, AS AVAILABLE BASIS. NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT TO LNKCOM OR ANY INFORMATION OR SOFTWARE THEREIN. THIS 'NO WARRANTY' EXPRESSLY INCLUDES ANY REIMBURSEMENT FOR LOSSES OF INCOME DUE TO DISRUPTION OF SERVICE BY LNKCOM OR ITS PROVIDERS.

h) LNKCOM is not responsible for The Client's personal or business files residing on LNKCOM equipment. The Client is responsible for independent backup of data stored at LNKCOM.

i) LNKCOM reserves the right to delete The Client's personal or business files after one or both parties terminate this agreement.

j) THE CLIENT HEREBY AGREES THAT ANY MATERIAL SUBMITTED FOR PUBLICATION OR STORAGE ON LNKCOM EQUIPMENT THROUGH THE CLIENT'S ACCOUNT(S) DOES NOT VIOLATE OR INFRINGE ANY COPYRIGHT, TRADEMARK, PATENT, STATUTORY, COMMON LAW OR PROPRIETARY RIGHTS OF OTHERS, OR CONTAIN ANYTHING OBSCENE OR LIBELOUS.

k) LNKCOM, at its sole business judgment, may terminate this agreement without prior verbal or written notification immediately or suspend The Client's access to the service upon any breach of this Agreement, Terms Of Use, Acceptable Use Policy, or Zero Tolerance SPAM Policy by The Client, including, but not limited to, refusal or failure to pay for services provided or by sole judgment of LNKCOM that The Client may be performing activities harmful to LNKCOM or its clients, users, employees, vendors, business relationships or any other users of the Internet.

l) Due to the public nature of the Internet, all electronic mail is considered publicly accessible and important information should be treated carefully.

m) Use of any distribution lists in electronic mail or other mass electronic mailings is subject to approval by LNKCOM.

n) Non-enforcement of any section of these Terms Of Use does not constitute consent and LNKCOM reserves the right to enforce these Terms Of Use at its sole discretion.

o) LNKCOM may only be used for lawful purposes. Transmission of any material in violation of any US or state regulation is prohibited. This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. The Client agrees to indemnify and hold harmless Link Communications, Ltd. from any claims resulting from use of the service which damages you or another party.

p) Any access to other networks connected to LNKCOM must comply with the rules appropriate for that other network. Use of LNKCOM itself may be for any lawful purpose.

q) Billing of The Client's Dial-Up or Web-Hosting Account will begin upon creation of the account (including any setup fees plus current month). Charges for the first month of service will not be refunded should The Client decide to cancel the account, for any reason. Charges will normally be billed on the last day of each month for the upcoming month of service. Credit Card payments will be processed on or about the last day of each month. In the event The Client does not pay his/her invoice in full within five (5) days of the date of said invoice, or in the event The Client defaults pursuant to the terms hereof, and in the event legal proceedings are instituted to collect said invoice, or enforce the terms of these conditions, The Client will be responsible and liable for all costs, fees, charges, expenses and reasonable attorneys' fees incurred in connection with LNKCOM efforts in enforcing the terms and conditions set forth herein.

r) Service is invoiced monthly in advance and may be canceled at any time, without penalty. In the event such cancellation occurs after the current billing cycle, The Client will not be entitled to any refund (total or partial) for services billed. LNKCOM reserves the right to change the rates by notifying The Client 30 days in advance of the effective date of the change.

s) The Client will adhere to the LNKCOM ZERO TOLERANCE SPAM POLICY at all times.

t) The Client will notify LNKCOM of any changes in account information such as The Client's name, address and/or phone number. This Agreement shall not be verbally or orally revised, changed or modified in any form or fashion whatsoever.

u) USE OF LNKCOM SERVICE(S) CONSTITUTES THE CLIENT'S TOTAL AND IRREVOCABLE ACCEPTANCE OF ALL THE TERMS AND CONDITIONS SET FORTH HEREIN.

v) These Terms Of Use supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Use of LNKCOM service(s) constitutes acceptance of these Terms and Conditions.

w) LNKCOM reserves the right to change without notice the LNKCOM service, including, but not limited to, access procedures, hours of operation, menu structures, commands, documentation, vendors and services offered.

x) These Terms Of Use shall in all respects be subject to, and governed by, the laws of the State Of Maryland.

ACCEPTABLE USE POLICIES:

The Client agrees to the following:

1. LNKCOM services may only be used for lawful purposes. Transmission of any material in violation of any U.S. or state regulation is prohibited. This includes, but is not limited to, defamatory, copyrighted material, threatening or obscene material, statements that are bigoted, hateful or racially offensive, or material protected by trade secret. User agrees to indemnify and hold harmless LNKCOM from any claims resulting from your use of this service which damages user or another party. At our sole discretion and without notice, LNKCOM may revoke a user's access for inappropriate usage.

2. Any dial-up connection being used as a dedicated connection or using 'software' to keep a connection established without actively using the service is prohibited.

3. LNKCOM, at its sole discretion, reserves the right to cancel or disconnect a user's account if LNKCOM has detected or suspects inactivity during a sustained connection period.

4. Use of any information obtained via this service is entirely at user's own risk. LNKCOM specifically denies any responsibility for the accuracy or quality of information obtained through our services.
